Artificial intelligence (AI) is reshaping care at home. It is important to understand how to use AI while navigating its policy and compliance implications.
Deborah Hoyt, Senior Vice President of Public Policy at Axxess, moderated a multi-part webinar series, along with Christinia Betanzos, General Counsel at Axxess, and Arlene Maxim, Senior Vice President of Clinical Services at Axxess, speaking about the requirements, regulations and the roadmap for AI in care at home.
Understanding the Regulatory Environment
While potential comprehensive federal laws are still on the horizon, existing regulations, including the Medicare Policy and Conditions of Participation, already apply and new state-level legislation is emerging rapidly.
The Centers for Medicare and Medicaid Services (CMS) has issued requests for information, signaling their intent to establish parameters for AI use.
“We’re in an early stage right now and we don’t have a lot of AI-specific regulations that we’re concerned about,” Maxim said. “However, the regulations we do have will impact AI.”
Maxim highlighted five areas that will drive future regulations, and organizations should be prepared for them:
- Patient Safety: Implement validation processes and establish error and correction protocols.
- Mitigation of Bias: Ensure AI algorithms are fair and equitable across diverse populations.
- Transparency: Clear visibility into how AI is used in clinical records and operations.
- Data Privacy: Protect health information and other sensitive data.
- Clinical Accountability: Ensure clinicians maintain oversight and responsibility for AI-driven decisions.
Betanzos noted that states are not waiting for federal action.
“In 2025 alone, states have introduced over 1,000 pieces of legislation,” Betanzos explained. “It shows how active states are being in the area of AI.”

Implementing Compliance Strategies
Betanzos provided actionable strategies to mitigate risk while innovating responsibility:
- Perform an AI Audit: Create an inventory of all AI tools used within your organization and categorize them by risk.
- Develop a Governance Framework: Develop policies and practices for responsible AI deployment, use and management.
- Have Practical Guardrails: Communicate company policies, practices and expectations, including an acceptable use policy.
Success in AI isn’t just about technology; it’s about alignment. An AI roadmap, built on a clear vision of how AI supports strategic, operational and financial goals, is foundational.
“Artificial intelligence is inevitable,” emphasized Betanzos. “It’s reshaping care delivery. With proper guardrails and trusted partners, AI can save time, improve performance and keep organizations from being left behind.”
